Terms of Service

By engaging the services of Gareth Haddon, trading as Haddon Digital Group ("the Developer"), the Client ("you") agrees to be bound by the following terms and conditions.

1. Scope of Services

The Developer agrees to provide a high-performance website rebuild for jd-therapies.co.uk including:

  • Technical rebuild using Next.js/Tailwind CSS.
  • Core Web Vitals and Mobile Speed optimization.
  • Acuity Scheduling integration and Technical SEO implementation (Schema.org, Meta data).
  • A 14-day "Snagging Period" following the project go-live.

2. Payment & Financial Terms

  • Fixed Fee: The total project cost is £599.
  • Payment Schedule: Full payment is due upon completion and client satisfaction, prior to the website being pointed to the live domain.
  • Late Payment: The Developer reserves the right to withhold the transfer of files or "go-live" services until the balance is cleared in full.

3. Limitation of Liability (IMPORTANT)

  • Financial Cap: To the extent permitted by law, the Developer's total liability for any claims, losses, or damages arising out of this agreement shall not exceed the total fee paid by the Client (£599).
  • Loss of Earnings: The Developer shall not be liable for any indirect or consequential loss, including but not limited to: loss of profits, loss of revenue, loss of business, or loss of data.
  • Third-Party Failures: The Developer is not responsible for the performance or uptime of third-party services, including hosting providers, domain registrars, or API integrations (e.g., Acuity Scheduling).

4. SEO & Performance Disclaimer

While the Developer employs industry-standard Technical SEO strategies to improve search engine visibility, the Client acknowledges that:

  • Search engine rankings are governed by third-party algorithms beyond the Developer's control.
  • The Developer makes no guarantee of specific ranking positions or "Top 5" placement within a specific timeframe.

5. Intellectual Property & Ownership

  • Transfer of Rights: All copyright and intellectual property rights for the custom code and website design transfer to the Client only upon receipt of the final payment of £599.
  • Portfolio Usage: The Developer retains the right to display the completed project in professional portfolios and marketing materials unless otherwise agreed in writing.

6. Client Responsibilities

The Client is responsible for providing high-resolution imagery, final copy, and necessary access credentials in a timely manner. The Developer is not liable for project delays caused by a lack of Client input. The Client is responsible for their own data backups following the conclusion of the 14-day snagging period.

7. Governing Law

These terms are governed by and construed in accordance with the Laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Data Protection (UK GDPR & DUAA 2025)

The Client acknowledges that they are the 'Data Controller' and Haddon Digital Group is the 'Data Processor' for the purposes of UK Data Protection law. The Client is responsible for ensuring the website's Privacy Policy and cookie consents are legally compliant. The Developer will implement 'Privacy by Design' but is not responsible for the Client's ongoing data management.

9. Accessibility Standards

The Developer aims to deliver the website to WCAG 2.2 Level AA standards. However, once the site is handed over, any modifications, content uploads, or third-party plugin installations by the Client that result in accessibility non-compliance are the sole responsibility of the Client.

10. Non-Solicitation

The Client agrees that for a period of 12 months following the completion of the project, they will not, directly or indirectly, solicit or offer employment to any employee or subcontractor of Haddon Digital Group who was involved in the project.
